Litigation
Litigation is the primary form of dispute resolution in India which takes place in Courts and the Judges pass an order. The High Court is the highest Court at the State level, whereas the Supreme Court is the highest Court in the India, often referred to as the Apex Court.

Arbitration
Arbitration is a form of Alternate Dispute Resoluion mechanism, with a set of procedures different from that of litigation. The Arbitration & Conciliation Act, 1996 regulates the procedure and practice of Arbitration in India but the other laws applicable to it are the same as in litigation. Arbitration takes place before an Arbitrator, who can be a Retired Judge, a Lawyer or any other person who is qualified and experienced to adjudicate the dispute. The Arbitration process does not take place in a Court.

Mediation
Mediation is a completely confidential process of dispute resolution through which the disputing parties attempt to arrive at a mutually acceptable and mutually beneficial agreement, with the help of a Mediator. There are no complex Court procedures or Arbitration procedures involved in Mediation. The Mediator does not pass any order. The role of a Mediator is to guide the disputing parties to reach a settlement. This form of dispute resolution is the most time saving and cost effective. Mediation is effective in all kinds of Civil disputes, including family disputes, matrimonial disputes, commercial disputes and even workplace disputes.
